You can click on Advanced Search and then enter the name of your new product. You can also limit your search with many other criteria such as the classes for goods and services. One very interesting feature is the possibility to also search for similar trademarks. Lets use an example: we want to lauch a new line of t-shirts under the name of marimba. So we enter marimba in the trademark field. We also want to limit the search to class 25 for clothing. Also, we could add classes 18 for bags, 14 for jewellery and 35 for retail services, since these are sometimes considered similar. And then we check the checkbox called Fuzzy. We cold in theory limit the search to particular offices. After submitting the search we are presented with all the similar trademarks in class 25. Your patent attorney is liable for what he says and if your are successfully sued by an owner of,an earlier mark, the insurance of your patent attorney may cover for the damage in case he said that he does not expect any issues with this particular trademark. Also, experienced trademark professionals will know the relevant caselaw when two trademarks are considered too similar. You can Thomson Thomson to run a detailed paid search. You should also try to pick "arbitrary and fanciful" names as opposed to suggestive and descriptive terms. In other words "Nike" or "Xerox" are better names than "Sports Shoes Company" or "Copy Paper Inc." Be creative - think out of the box. Also, keep in mind there are many different things you can get a trademark (for goods) or service mark (for services) for. Examples are: 1. Your company logo 2. A slogan you use in your business 3. TRADEMARK SEARCH A trademark search, also known as the “clearance” process, should be conducted before applying for trademark registration so that you do not waste the non-refundable filing fee. The USPTO’s Trademark Electronic Search System (TESS) can be used to conduct a free clearance search for word marks, design marks, and combinations of words and designs that are being used or applied for. The search focuses on whether there is a “likelihood of confusion” between your mark and a mark that has already been applied for or registered. A likelihood of confusion results when there is the same or similar mark and related goods and services. If there is a likelihood of confusion, your mark will be refused. There are no set rules for conducting a search. The TESS (for Federal registrations and applications), Secretary of State web sites (for State registrations), and online internet searches (for common law trademarks) should be examined. Furthermore, the marks must be evaluated to determine if they are in the same class of goods and services. A comprehensive search is offered by trademark search companies. The price ranges from $800 to $1,000. The trademark search company will run a better search strategy than any other individual or entity. They have state common law databases, and search domain names, business names, and many other categories. Still, a comprehensive search is not perfect, although very recommended when you think you have an important mark that has value to you.

I will give you a brief overview of the most important changes and new things to know. There will be a class fee for each class that is claimed in the new EU trademark. There is no longer a flat fee for the first three classes. Claiming goods and services: claiming all Nice class headings in a given class no longer automatically claims ALL goods and services in the class, even if they do not fall under the class headings (e.g. translation services). There is a grace period of 6 months to claim all goods in a given class. There is a new type of trademark called the "certification mark", which I explain in the video. Disclaimers can no longer be used to overcome absolute ground rejections. Functional signs (color, sound, smell, ...) will be subject to the same prohibitions applied to shape marks. EU Trademarks cannot be filed via the national offices. Users of the system can choose to receive search reports or surveillance letters. The time limit for third-party observations is now defined in a new way. The new EU trade mark Regulation enters into force on March 23rd. As a result, the Office for Harmonization in the Internal Market (OHIM) will change its name to the European Intellectual Property Office (EUIPO).
